I’d like to know: if someone is writing a screenplay using, let’s say Chucky from the Child’s Play series and creating another installment to the horror franchise, do they need copyright permisson from the creator and how would they go about it?
Yes, you would need copyright permission. I couldn’t tell you who owns the rights. Several studios/distributors have been involved in the series. Devil’s Due Publishing owns the publishing rights to the comic books. Don Mancini has written all of the screenplays. There are reports that pre-production has started on a new sequel. If this is what inspires you just go ahead and write it, if for no other reason than practice.
